Candidate for Orange County Commission, May Not Be a Candidate After All

After receiving a scathing letter from the Mayor of Altamonte Springs for improperly inserting himself into a photograph at a groundbreaking ceremony in Altamonte Springs, it
appears that Alvin Moore, Councilman and Vice Mayor of Eatonville, Florida, may have followed the improper procedure to resign from his council seat in a timely manner and his campaign for Orange County Commission District 2 may be in jeopardy.
Under Florida law, in order to run for Orange County Commission Moore was required to
submit his letter of resignation to the Town Council to the Eatonville Town Clerk, Debbie Franklin, on or before June 6, 2014. Additionally, a copy of his resignation letter was to be sent to the Governor's Office and the Florida Department of State within the same time period. According to a public records request to the Town of Eatonville, Moore did not officially submit his resignation letter to the Town Clerk until June 18th via email, 12 days after the deadline.
Although Moore purportedly sent his resignation letter to Governor Rick Scott on May 30th, the law clearly states that he was to submit his resignation to the Town Clerk, not the Governor of the State of Florida. Moreover, there is no record to prove that Moore ever sent a copy of the resignation letter to the Department of State as required by Florida law.
Greg Jackson, a former Assistant Attorney General and candidate for Orange County Commission District 2 was asked to comment on this issues and only had this to say: "As an elected official seeking to lead Orange County, I suspect Mr. Moore had an understanding of what his responsibilities are in order to resign his position from Eatonville's Council, and I would expect Mr. Moore to follow the letter of the law to prevent any issues with his campaign."
A public records request to the Governor's Office and the Florida Department of State are pending to determine if those agencies received Moore's resignation from the Eatonville Council in compliance with Florida law.
